Acceptable Use Policy (AUP)

Hosticky provides premium hosting infrastructure designed for legitimate businesses, agencies, and professionals. To protect the integrity, reputation, and performance of our network, we enforce a strict Acceptable Use Policy. Zero tolerance means zero tolerance.

1. Email Spam and Mass Mailing

We maintain a strict zero-tolerance policy against unsolicited commercial email (UCE) and spam. You may not use our network to send spam, bulk marketing emails without confirmed opt-in, or host sites advertised via spam. Any account caught sending spam will be suspended immediately without warning and without refund.

2. Illegal Content & DMCA Violations

You may not host, distribute, or link to any content that is illegal, infringes on copyright (DMCA violations), or promotes illegal activities. This includes, but is not limited to: pirated software (nulled scripts), copyrighted movies/music, child exploitation material, and illicit drugs. We actively cooperate with law enforcement and copyright holders. Valid DMCA complaints will result in immediate content removal or account termination.

3. Phishing, Malware & Hacked Sites

Hosting phishing pages, malware, viruses, botnets, or scripts designed to exploit other networks is strictly prohibited. If your website is compromised or hacked due to your own negligence (e.g., outdated plugins, weak passwords) and it begins to harm our hardware, network, or IP reputation, we will suspend or terminate your account immediately without any refund. We cannot and will not bear the loss for cyber attacks resulting from your insecure applications. Securing your application is 100% your responsibility.

4. Resource Abuse & Server Overloads

Our shared hosting environments are for functional websites, not testing grounds for poorly optimized scripts, scraping bots, or continuous background processing (e.g., crypto mining, heavy cron jobs). Any account consuming excessive CPU, RAM, or I/O that overloads the server and affects other users will be throttled or immediately suspended. We reserve the right to terminate accounts that persistently drag down server performance or threaten our hardware stability.

5. The Definition of "Unlimited" (Fair Use)

Where a plan specifies "Unlimited" bandwidth, disk space, or websites, this refers to unmetered usage for standard, legitimate business or personal websites. "Unlimited" does NOT mean infinite. You may not use our hosting as a file dump, backup repository, media streaming server, or file sharing portal. Usage that falls outside the normal operation of a standard website will be flagged as a violation of our Fair Use Policy, resulting in restriction or termination.

6. Consequences of Violation

Violation of any part of this AUP will result in immediate suspension or termination of your services. No backups will be provided to abusers, and no refunds (wallet or otherwise) will be issued. We reserve the right to levy cleanup fees for any damage caused to our network reputation (e.g., IP blacklisting).
